These Terms of Service (“Terms”) govern your access to and use of the Golden Score Gear website, online store, products, and related services.

Throughout these Terms, “Golden Score,” “Golden Score Gear,” “we,” “us,” and “our” refer to Golden Score Gear and its applicable owners and operators.

By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms and any policies incorporated into them by reference.

If you do not agree to these Terms, you should not use our website or purchase products through it.

1. Online Store Terms

By using this website and placing an order, you represent that you are legally capable of entering into a binding agreement or are using the website with the authorization of a parent or legal guardian where required.

You may not use our products, website, or services for unlawful purposes or in violation of applicable laws.

You may not attempt to interfere with the operation, security, or integrity of our website or services.

2. Products & Services

Golden Score sells apparel, martial arts equipment, athletic apparel, accessories, and related products.

Certain products may be manufactured, printed, embroidered, customized, or otherwise produced after an order is placed.

We reserve the right to modify, discontinue, limit, or replace products at any time, subject to our obligations regarding orders already accepted.

Product availability may vary.

3. Product Images & Descriptions

We make reasonable efforts to accurately represent our products.

However, product photographs, digital mockups, renderings, lifestyle images, and other visual representations may differ slightly from the physical product.

Colors may vary due to screen settings, lighting, fabric characteristics, printing methods, manufacturing processes, and production runs.

Minor variations in print placement, embroidery placement, stitching, color, texture, measurements, and other characteristics may occur and do not necessarily constitute defects.

4. Sizing

Customers are responsible for reviewing applicable size charts and product information before ordering.

Sizing and fit may vary between products, manufacturers, styles, and blanks.

Unless otherwise provided by our Return & Refund Policy, receiving the size that was ordered but determining that a different size would fit better does not constitute a manufacturing or fulfillment defect.

5. Orders

Submitting an order does not necessarily guarantee acceptance of the order.

We reserve the right to refuse or cancel an order when reasonably necessary, including because of:

Product unavailability
Pricing or listing errors
Suspected fraud or unauthorized payment activity
Shipping restrictions
Technical errors
Inability to fulfill the order
Violation of these Terms

If we cancel an order after payment has been collected and no applicable amount is otherwise owed, the affected amount will be refunded.

6. Pricing & Payment

Prices are displayed in the currency indicated at checkout and are subject to change without notice.

The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious errors as permitted by law.

Applicable taxes, shipping charges, and other fees will be displayed or calculated during checkout when required.

You agree to provide current, complete, and accurate billing and payment information.

7. Promotions & Discount Codes

Promotions, discount codes, free-shipping offers, and other special offers may be subject to additional conditions.

Unless otherwise stated, promotional offers:

Cannot be redeemed for cash
May not be combined with other offers
May have eligibility requirements or expiration dates
May be modified or discontinued as permitted by applicable law

Abuse, manipulation, or unauthorized use of promotional offers may result in cancellation of the discount or affected order.

8. Shipping

Products may be manufactured, stored, or fulfilled from multiple facilities and distribution locations.

An order containing multiple products may therefore be divided into multiple shipments. Products from the same order may arrive at different times and may have separate tracking numbers.

Shipping charges for orders that do not qualify for free shipping may reflect multiple fulfillment locations.

Eligible U.S. orders of $100 or more may qualify for free standard shipping, subject to the conditions displayed at checkout and any exclusions disclosed by Golden Score.

Shipping and delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

9. Risk of Loss & Delivery

Delivery is performed by third-party shipping carriers.

If an order is delayed, lost, damaged, or marked delivered but cannot be located, please contact Golden Score so we can review the circumstances and determine the appropriate resolution under our Shipping and Return & Refund Policies.

Customers are responsible for providing accurate and complete shipping information.

Additional costs resulting from an incorrect or incomplete address may be the customer's responsibility to the extent permitted by law.

10. Made-to-Order Products

Many Golden Score products are produced specifically after an order is submitted.

Once production begins, an order may not be eligible for cancellation, modification, return, or exchange simply because the customer changes their mind, orders an incorrect size, or selects an incorrect color.

This does not affect remedies available for damaged, defective, misprinted, incorrect, or otherwise nonconforming products.

11. Returns, Refunds & Exchanges

Returns, refunds, replacements, and exchanges are governed by our Return & Refund Policy.

Generally, made-to-order products cannot be returned or exchanged due solely to buyer's remorse, preference, or selection of an incorrect size or color when the product supplied matches the order.

If a product arrives damaged, defective, misprinted, or materially different from the product ordered, contact Golden Score with your order information and photographs of the issue.

Nothing in these Terms limits rights or remedies that cannot legally be waived.

12. Cancellations & Order Changes

We cannot guarantee that an order can be canceled or modified after it has been submitted.

Because made-to-order products may enter production shortly after purchase, customers should contact Golden Score immediately if a change is necessary.

Once production begins, cancellation or modification may no longer be possible.

13. Combat Sports & Athletic Activities

Participation in Judo, Brazilian Jiu-Jitsu, wrestling, mixed martial arts, martial arts, fitness, strength training, and other athletic activities involves inherent risks.

Golden Score products do not eliminate the risk of injury.

Customers and athletes are responsible for determining whether products are appropriate for their intended use and for participating in athletic activities with appropriate instruction, supervision, precautions, and safety practices.

Nothing provided through the Golden Score website constitutes medical, safety, coaching, or professional training advice.

14. Competition Eligibility

Unless expressly stated on a particular product page, Golden Score does not represent or warrant that a product is certified, approved, or authorized for use by the International Judo Federation (IJF), USA Judo, IBJJF, or any other federation, tournament organizer, association, or governing body.

Competition rules may change.

Athletes are responsible for verifying that their equipment complies with the rules applicable to their specific event before competing.

15. Intellectual Property

All Golden Score names, logos, graphics, artwork, photographs, product designs, website content, text, illustrations, and other original materials are owned by, licensed to, or otherwise lawfully used by Golden Score unless otherwise stated.

You may not reproduce, distribute, sell, modify, publish, commercially exploit, or create derivative works from Golden Score intellectual property without prior written permission, except as permitted by applicable law.

Third-party trademarks and intellectual property remain the property of their respective owners.

16. Reviews, Photos & User Content

If you voluntarily submit a review, photograph, testimonial, comment, or other content to Golden Score for publication, you represent that you have the right to submit that content.

To the extent permitted by law and subject to any separate terms presented when content is submitted, you grant Golden Score a non-exclusive, worldwide, royalty-free license to display, reproduce, and use submitted content in connection with operating and promoting Golden Score.

We will not knowingly claim ownership of intellectual property that remains yours.

We reserve the right to decline or remove content that is unlawful, fraudulent, abusive, infringing, misleading, or otherwise inappropriate.

17. Prohibited Uses

You may not use this website to:

Violate applicable laws or regulations
Infringe intellectual property rights
Submit false, fraudulent, or misleading information
Transmit malicious software or harmful code
Attempt unauthorized access to our systems
Scrape, harvest, or misuse customer or website data
Interfere with website security or operation
Engage in fraudulent purchases, chargebacks, or payment activity
Impersonate another person or entity

We may restrict access or cancel orders associated with prohibited conduct where reasonably appropriate.

18. Third-Party Services

Golden Score may use third-party services for payment processing, ecommerce hosting, manufacturing, fulfillment, shipping, analytics, communications, and other business functions.

Your use of certain third-party services may also be subject to the terms and privacy practices of those providers.

Golden Score is not responsible for independent third-party websites or services outside our reasonable control.

19. Errors & Inaccuracies

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, availability, or other information.

We reserve the right to correct such errors and update information as permitted by applicable law.

20. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

ANY WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED REMAIN UNAFFECTED.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOLDEN SCORE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THIS WEBSITE, SERVICES, OR PRODUCTS.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Golden Score and its owners, officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.

24. Severability

The remaining provisions will continue in effect.

Failure by Golden Score to enforce a provision of these Terms does not constitute a waiver of that provision or any other rights.

26. Entire Agreement

These Terms, together with the policies and notices incorporated by reference, constitute the agreement between you and Golden Score concerning your use of the website and purchases made through it, except where additional written terms expressly apply.

27. Governing Law

These Terms and disputes arising from them will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in this provision deprives a consumer of protections that cannot legally be waived.
